Terms of service
1. Scope and provider
These terms apply to the BeroNetwork Discord Bot and its web dashboard. The provider is the private individual identified in the legal notice.
2. Service
BeroNetwork is provided voluntarily and free of charge. It helps manage Discord servers through configurable features such as tickets, moderation, reaction roles, analytics, and notifications. There is no entitlement to uninterrupted availability, any particular feature set, or the continued provision of an individual feature.
3. Requirements
You need a valid Discord account and, for administrative features, the appropriate permissions on the relevant Discord server. Discord's own terms and minimum age requirements also apply.
4. User and server operator responsibilities
You must not use the service unlawfully, abusively, or in a way that infringes another person's rights. In particular, you must not distribute unlawful content, bypass security measures, or deliberately disrupt the service or its infrastructure.
The server operator is responsible for its configuration, instructions, and content on its server. This includes text, messages, and other content it instructs the Bot to send or store. The server operator must have a legal basis for processing, provide transparent information to affected people, and meet its obligations as controller.
5. Availability and changes
Maintenance, technical problems, and changes may affect availability. Features may be changed, added, or removed at any time, and the service may be discontinued entirely.
6. Liability
Because BeroNetwork is provided free of charge, the provider is liable only for intent and gross negligence. This limitation does not apply to injury to life, body, or health, or where liability is mandatory under applicable law.
7. Ending use and deletion
Use on a server ends when the Bot is removed. Server data is deleted no earlier than 30 days later, during the next daily run after 4:00 a.m. If the Bot is added again during that grace period, deletion is cancelled. Server administrators may use the dashboard button to initiate deletion immediately. The Bot's analytics buffer is discarded on the next job run. The Bot remains on the server; continued use may create new data after deletion.
8. Data processing terms under Article 28 GDPR
This section is a data processing agreement. It applies between the server operator as controller and the BeroNetwork provider as processor as soon as the server operator uses the Bot on its Discord server.
8.1 Subject matter, duration, nature, and purpose
The subject matter is the technical provision of the Bot and dashboard for the relevant Discord server. Processing begins when the Bot is added or first used and continues until the server data is deleted after use ends. BeroNetwork collects, receives, organises, stores, reads, changes, transmits, and deletes data only as necessary to perform features configured by the server operator, administer the server, and operate the service securely.
8.2 Types of data and categories of data subjects
The server, configuration, content, usage, and log data described in the privacy policy are processed, including Discord IDs and ticket, moderation, invite, poll, giveaway, alarm, booster, birthday, and analytics data. Data subjects include server owners, administrators, moderators, members, inviters, joining members, ticket participants, voters, giveaway entrants and winners, and other people whose content the server operator instructs BeroNetwork to process.
8.3 Instructions
BeroNetwork processes personal data only on the server operator's documented instructions unless European Union or German law requires processing. Instructions are given by selecting, configuring, using, disabling, and deleting features in the Bot or dashboard and through supplementary communications. Where the law requires processing without an instruction, BeroNetwork will inform the server operator before processing unless the law prohibits this. If BeroNetwork considers an instruction unlawful, it will inform the server operator without undue delay and may suspend the instruction until it is clarified.
8.4 Confidentiality and security
BeroNetwork ensures that people authorised to process data are bound by confidentiality or an appropriate statutory duty and act only on instructions. Taking into account the nature, scope, context, and purposes of processing and the risks involved, appropriate technical and organisational measures under Article 32 GDPR are maintained. These include permission checks, least-privilege access, encryption in transit, protected storage of credentials and secrets, logging of security-relevant web access, timely security updates, and procedures for deletion and restoration of availability.
8.5 Subprocessors
The server operator gives general authorisation for the use of subprocessors. At the start of use, these are dataforest GmbH for hosting and infrastructure and Discord for technical platform and API operation to the extent Discord acts as a processor or subprocessor. Where Discord processes data as an independent controller, Discord's privacy terms apply. BeroNetwork will give notice of intended subprocessor changes by updating these terms or through another suitable notice and will give the server operator an opportunity to object on material data protection grounds. Where legally required, subprocessors are contractually bound to equivalent data protection obligations. BeroNetwork remains responsible for the subprocessor's performance of its obligations.
8.6 Assistance and notifications
Taking into account the nature of processing and the information available, BeroNetwork reasonably assists the server operator with data subject requests, security under Article 32 GDPR, personal data breach notifications under Articles 33 and 34 GDPR, data protection impact assessments, and prior consultations under Articles 35 and 36 GDPR. BeroNetwork will notify the server operator of a personal data breach within its area of responsibility without undue delay. Requests from data subjects concerning server data will be forwarded to the server operator unless BeroNetwork is authorised to respond directly.
8.7 End of processing
After use ends, the server operator chooses whether BeroNetwork returns or deletes all personal data and existing copies. BeroNetwork carries out that choice on the server operator's instruction. This does not apply to the extent European Union or German law requires continued storage of the personal data.
8.8 Evidence and audits
On request, BeroNetwork will provide the server operator with the information necessary to demonstrate compliance with Article 28 GDPR. At reasonable intervals and on reasonable notice, the server operator may conduct audits itself or through an auditor bound by confidentiality, provided legitimate security and confidentiality interests and the rights of other users are protected. BeroNetwork will contribute to such audits and will immediately inform the server operator if it believes an audit instruction infringes data protection law.
9. Changes to these terms
These terms may be updated when the service, the law, or its technical environment changes. The current version and its effective date will be published on this page. Changes to the data processing section will be identified so that the server operator can exercise its statutory review and objection rights.
10. Governing law
German law applies. Mandatory consumer rights remain unaffected, including protection under mandatory rules of the country in which a consumer usually resides.
